The codes of practice were subject to a public consultation earlier in 2017 and the government’s response to that consultation has been published alongside the codes themselves.

In addition to the codes of practice and the consultation response, four sets of regulations under the Investigatory Powers Act were also laid in Parliament in draft on 18 December.

These regulations cover a number of technical provisions giving effect to the act’s provisions:

  • the Investigatory Powers (Codes of Practice) Regulations 2018 – bringing into effect the codes set out above
  • investigatory Powers (Technical Capability) Regulations 2018
  • the Investigatory Powers (Review of Notices and Technical Advisory Board) Regulations 2018
  • the Investigatory Powers (Interception by Businesses for Monitoring and Record-keeping purposes) Regulations 2018
